Chapter 1 General Provisions

Article 1 (Purpose)

The purpose of These Terms and Conditions of Use (hereinafter referred to as the "Terms and Conditions of Use") is to regulate the terms and procedures for using all services (hereinafter referred to as "Services") provided by the Korea Electronic Travel Authorization (K-ETA) website (hereinafter referred to as "website") operated by the Korea Immigration Service Ministry of Justice of the Republic of Korea, the rights and obligations of this site and users, and other necessary matters.

Article 2 (Definition)

• 4. “Sign up” refers to the act of entering the relevant information in the membership registration form provided by this website and agreeing to these terms and conditions of use to complete the service use agreement as a member.

• 5. “Email verification” refers to an act of verification to whether or not the identification of the user and applicant are the same, and to protect confidential personal information on the internet.

• 6. “ID” refers to the email address entered by the member and approved by this website for member identification and service use.

• 7. “Password” refers to a combination of letters, numbers, and special characters selected by the member to confirm that the user and member ID match and to protect the member’s confidentiality in communications.

• 8. “Application” refers to the act of a user who agrees to these Terms and Conditions of Use filling out the required information in the service application form provided by this website and submitting the application.

• “Applicant” refers to the personal information subject who has filled in the required information in the service application form provided by this website and completed the submission of the application form.

• 10.“Application number” refers to a combination of letters and numbers given by this website for identification of users and for users to use services.

• 11. “Administrative Fee” refers to the cost of ETA application that the applicant needs to pay using an online payment service through an electronic payment agency when applying for the ETA.

• 12. "Membership withdrawal" refers to the act of terminating the service agreement for the services provided to a member as a member.

② Terms not defined in these Terms and Conditions shall be governed by the relevant laws, separate terms and conditions for each service, and the terms of use.

Article 3 (Validity and Revision of Terms and Conditions)

① These Terms and Conditions shall become effective by notifying the user through the service screen or other means, and if the user agrees to the contents of these Terms and Conditions, these Terms and Conditions shall take precedence over the services of this website and the user’s use of the service.

② This website provides services on the condition that the user agrees to the contents of these Terms and Conditions.

③ If this website revises these Terms and Conditions, the reason for the revision and the date of application shall be clearly stated on this website from 7 days before the date of application to the day before the date of application. Notice.

② Matters not specified in these terms and conditions shall be governed by the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Framework Act on Telecommunications, the Telecommunications Business Act, the Deliberation Regulations of the Korea Internet Safety Commission, the Information and Communications Ethics Code, the Program Protection Act, and other related laws and regulations.

Chapter 2 Service Provision and Use

Article 5 (Establishment of Use Contract)

① The use contract of this website is established when the user agrees to these terms and conditions online and completes the required information in the registration or application form provided by this website.

② Consent to these terms and conditions of this website shall be expressed by clicking the ‘Agree’ button.

② The user expresses his/her intention to agree to these terms and conditions by clicking the ’Agree’ button.

③ The services provided by the website are self-developed from the website or by consultation with other institutions, and by notifying the user, the contents of the provided service can be changed.

Article 6 (Reservation and rejection of approval of use contract)

① In the case of any of the following, the website may reserve the establishment of the use contract until the cause is resolved.

• 2. In the event of insufficient service-related capacity

• 3. In the event that a key telecommunications business operator pursuant to the Telecommunications Business Act suspends telecommunications services

• 4. In case of war, incident, natural disaster, or other states of national emergency occur or may occur

• 5. In case of unavoidable circumstances such as urgent system inspection, expansion, and maintenance of replacement equipment

• 6. In case of service equipment failure or service usage overload, or other reasons that make it impossible to provide services

② If the user engages in any of the following, the website may reject the use contract or cancel the user agreement that has already been established.

• 1. When using the services of this website by impersonating another person

• 2. When using the services of this website by providing false information such as submitting false documents

• 3. When using the services of this website for the purpose of disrupting the peace and order of society or public morals

• 4. When disrupting other users’ use of the services of this website or intentionally disrupting the operation of the services of this site by hacking, distributing computer viruses, etc.

• 5. When using the website to commit acts prohibited by laws, these Terms and Conditions, separate terms and conditions, or usage regulations

• 6. When the business location of a travel agency or medical institution is not operating normally due to temporary closure or other reasons

• 7. When using the information listed on this website for commercial purposes

• 8. If there is a significant reason to believe that it is inappropriate to maintain user qualifications, such as violating other provisions of these Terms or related laws

• 9. When attempting re-registration or re-application despite the use contract being rejected or cancelled pursuant to each item of Article 6, Paragraph 2

• 10. When approval for use is difficult due to other reasons attributable to the user

Article 7 (Change of Member Information)

① If the member information entered when signing up has changed, the member must immediately edit it online. The member is responsible for all problems that arise due to failure to change it.

② In principle, the member ID cannot be changed. If the member wants to change it due to unavoidable reasons, the member must cancel (withdraw) the existing ID and sign up again.

③ The member is responsible for all problems that arise due to canceling (withdrawing) the ID or re-sign up.

Article 8 (Withdrawal of Membership)

① If a member does not want to receive the services provided by this website and has other reasons, the member may withdraw his/her membership at any time. When withdrawing, the member must verify his/her identity through email verification.

② Even if the member withdraws, the contents related to the application results for K-ETA will not be deleted.

Article 9 (Consent to Use of Personal Information and its Protection)

① The privacy policy of this website is applied to the personal information of the user.

② The website shall collect, use, and protect personal information as follows.

• 1. Collection of personal information: The website collects the user’s personal information through information provided or generated by the user when using the services of the website.

• 2. Use of personal information: Personal information collected pursuant to 1) above shall not be disclosed or distributed to a third party without the user’s consent. However, this does not apply for cases when a request is made according to legal procedures stipulated in relevant laws or when the user discloses his/her personal information provided to this website by him/herself. And if necessary for reasons such as integrated management of user information between websites of administrative institutions, relevant information may be provided to other administrative institutions.

• 3. Protection of Personal Information: Personal information collected pursuant to 1) above is protected by ID, password, email verification number, application number, passport information (passport number, date of birth, etc.). Therefore, you must not disclose your ID, password, email verification number, application number, passport information (passport number, date of birth, etc.) to others, and you must close the web browser window when you finish using it.

• 4. The user’s sign-up and application in accordance with these Terms and Conditions shall be deemed as consent to the use of the personal information collected in accordance with Paragraph 2, Item 1 above by this website.

Article 10 (Information Security of User)

① The user is responsible for maintaining the confidentiality of the information entered by the user from the moment the user uses the website service. The user must not share or transfer their ID, password, email verification number, application number, or passport information (passport number, date of birth, etc.).

② The user is fully responsible for any errors in service use or unauthorized use by a third party resulting from negligence in managing their ID, password, email verification number, application number, passport information (passport number, date of birth, etc.) and personal information.

③ The user is responsible for all management of ID, password, e-mail verification number, application number, and passport information (passport number or date of birth). When the user discovers that his/her ID, password, e-mail verification number, application number, or passport information (passport number or date of birth) have been illegally used, the user must immediately report this matter on the website. The user is fully responsible when failing to report such issue.

④ The user must correctly terminate the connection with this website every time the user uses it. This site is not responsible for any damages or losses caused by any use of information about the user by a third party due to not terminating the connection correctly.

Article 11 (Notification to the User)

① In operating the service, the website may notify the user of various information such as announcements regarding the website by posting it on the website or send e-mails or mails.

② In case of notification to unspecified users, the website may post the contents of the notification on the board of the website for more than one week instead of individual notifications.

Article 12 (Grant or Change Application Number)

① The website shall grant an application number to the user upon completion of application for K-ETA pursuant to the Terms and Conditions.

② The application number cannot be changed.

Article 13 (Service Hours)

① In principle, the service hours of the website shall be 24/7, given that there are no special disruption to the business or technology.

② The service hours in paragraph 1 excludes the time set by the website needed for regular maintenance, etc.

③ The website may designate separate hours for specific categories of services. In this case, the details will be announced.

Article 14 (Suspension of Service and Notice)

① The website may limit or suspend the provision of service in the event of maintenance, inspection, replacement, or breakdown of information communication facilities, disconnection of communication, service modification work, or high network congestion level.

② In case of service suspension pursuant to paragraph 1 above, the details of suspension will be notified on the website 1 week prior to the suspension. However, when unavoidable events occur such as an urgent system check, the abovementioned notice period may be shortened or omitted, and the website shall not bear any responsibility for damages or losses caused by the user’s failure to recognize the details of the notice.

③ The website shall not be responsible for any damage to the information processed by this website due to national emergencies, power outages, service facility failures outside the scope of the website’s management, or other force majeure.

④ The website is not responsible for any service failures caused by reasons attributable to the user.

⑤ In the event where the service is to be permanently suspended due to the circumstances of this website, the notice period shall be one month in advance.

Article 15 (Termination of Contract and Restriction of Use)

The website may terminate the use contract without prior notice or suspend the provision of services pursuant to each paragraphs of Article 19 of the T when a user violates the user obligations.

Article 16 (Copyright)

① The user cannot use, process, sell or provide information obtained by using the website for profit, Matters concerning copyright of the information materials shall be governed by the relevant laws.

② The user shall be solely responsible for civil and criminal responsibilities arising from the infringement of another’s copyright.

Article 17 (Deletion of Posts)

This website may delete, move, or deny registration of a post without prior notice if a post registered on this website’s board falls under any of the following.

• 1. Is in violation of this T or contains contents that is deemed to be commercial, advertising, obscene, or vulgar

• 2. Contains slanderous or defamatory content

• 3. In violation of public order or moral customs

• 4. Concerned or recognized to be related to criminal activities

• 5. In case of infringement or copyright or other rights of this website or a third party

• 6. Concerned regarding piracy or hacking

• 7. Is irrelevant with the board

• 8. Is deemed to be in violation of relevant laws

Chapter 3 Duties and Responsibilities

Article 18 (Duties of this Website)

① The website does not violate laws and this T, and strives to provide stable services.

② The website does not disclose or distribute information related to the user’s application, use information to a third party without their consent. However, this does not apply if there is a criminal investigation purpose or if there is a request based on other relevant laws and regulations, and if necessary for reasons such as integrated management of user information between websites of administrative institutions, relevant information may be provided to other administrative institutions.

③ The website should have a security system to protect the users’ personal information (including credit information) so that the users can use the services of this website safely.

Article 19 (Duties of the User)

① User must correctly enter requested information when using the service. Also, to maintain and manage correct information, the user should immediately update information if there have been any changes to the provided information. ID, password, e-mail verification number, application number and passport information (passport number, date of birth) should not be used or disclosed to third parties.

② User cannot engage in any profit-making activities using services provided by this website.

③ User cannot dispute any administrative fee imposed by the government of the Republic of Korea for the use of services provided by this site, and the user cannot request for a refund of the administrative fee which have already been paid.

④ User shall not engage in any of the following acts in relation to the use of this website service.

• 1. The act of wrongful or illegal use of another user’s ID, password, e-mail verification number, application number and passport information (passport number, date of birth)

• 2. The act of transmitting, posting, publishing, e-mailing or by other means sending contents that are abusive, slanderous, insulting, threatening, disseminating false information, or are defamatory or infringes on the privacy of others

• 3. The act of disguising the source of information

• 4. The act of posting, publishing, e-mailing or by other means sending contents that cannot be used under the relevant laws or the T

• 5. 5) The act of posting, publishing, e-mailing or by other means sending contents that infringe on others’ patents, trademarks, business secrets, copyrights or other intellectual property

• 6. The act of posting, publishing, e-mailing or by other means sending contents in the form of advertisements, spam mails, and lucky letters that have not been approved by the Ministry of Justice

• 7. The act of collecting or distributing personal information of others

• 8. The act of hacking or spreading computer viruses

• 9. The act of impersonating the website operator, employee, or authorities

• 10. The act of any arbitrary change of in part or all of the information posted on this website

• 11. The act of criminal activity purposes or related to other criminal acts

• 12. The act of violating public order or moral customs

• 13. The act deemed to be harmful or likely to harm the order of foreign residents, etc.

• 14. The act of defaming or insulting another person

• 15. The act of repetitively sending advertising content against the others’ will

• 16. The act of using the services of this website by providing false information, such as submitting false documents

• 17. The act of interfering with or is likely to interfere with the stable operation of the service

• 18. The act that violates these Terms and Conditions or any other separate terms or conditions or usage regulations set by this website

• 19. The act of violating other relevant laws

Chapter 4 Others

Article 20 (Ownership of this Website)

① The website owns the services, software, images, marks, logos, designs, service names, intellectual property rights relating to the information and trademarks, and other rights provided by this website.

② Except for cases explicitly approved by the website, users shall not modify, lend, borrow, sell, distribute, produce, transfer, re-license, set up security rights, or perform commercial use of all or part of each property mentioned in the above paragraph, and cannot allow third parties to do so.

Article 21 (Prohibition of Transfer)

The user cannot transfer or donate the right to use the service or other use contracts for use to another person, and it cannot be provided as collateral.

Article 22 (Damages)

The website shall not be liable for any damages incurred to the user regarding the services provided by the website, except for criminal acts intentionally committed by this website.

Article 23 (Indemnity)

③ The website shall be exempt from the liability in case of damages caused due to unavoidable reasons including repair, replacement, regular checkup, or construction of facilities.

④ The website is not responsible for any service failures caused by reasons attributable to the user.

⑤ The website is not obligated to represent any opinions or information of users expressed on the service.

⑥ This website is not responsible for any gains or losses incurred to you by relying on the information contained in the services provided by this website.

⑦ This website is not responsible for users not receiving the expected benefits from the services provided by this website.

⑧ This website has no obligation to intervene in disputes that arise between users or between users and third parties through the service, and is not responsible for compensating damages related to product transactions or monetary transactions made through the service.

⑨ This website is not responsible for any consequences that arise when the personal information subject provides his/her personal information to other users.

Article 24 (Competent Court)

The laws of the Republic of Korea will apply to the disputes between this website and users over the use of services, and lawsuits arising from this dispute will be filed in the competent court under the Civil Procedure Code.
